The Prosecutor General's Office has forwarded the case filed by the Information Commissioner's Office against the President's Office for withholding information to the Police.
The case was forwarded to the Police for them to investigate whether the claim has any elements of criminal negligence.
The prosecutor's office said it had the power to refer a person to the court for prosecution if he does not appeal against the decision of the Information Commissioner and the decision has not been implemented for 45 days.
However, the Prosecutor General's Office said that if a criminal charge is brought, such as disobedience to an order, it can only be done after a police investigation and the person responsible for the case has been identified.
It added that the Office has now forwarded the case to the Police for their investigation.
Many have expressed concern over the President's Office's failure to obey the Right to Information order issued by the Information Commissioner's Office.
