The Criminal Court has sentenced Mohamed Shaiban of Kaafu Maafushi to 10 years in jail for child molestation.
The Court said that on April 4th, 2020 around 3 pm, the defendant had taken the victim to a secluded room in the child's house and had performed sex acts with the victim.
The State has charged the defendant under Article 3, sections (A) and (C) of the Special Provisions Act to Deal with Child Sex Abuse Offenders which states that it is an offense to intentionally touch a child's body with sexual intent.
Defendant denied these charges.
The State submitted several pieces of evidence along with witness statements and the Court heard from the victim too. The Court said that the statement from the victim was transparent and that the victim had no ill intent against the defendant when the child made the claim.
The Court also determined that the victim's statement was extraordinarily honest and that Shaibaan was guilty of touching the child with sexual intent beyond a reasonable doubt.
While the defendant was sentenced to 10 years in jail, his prison sentence was cut down to 7 years and 4 days for time served.
