The High Court has revoked the injunction issued by the Criminal Court to release local nurse Haleemath Lamha, who was arrested concerning the murder of a Filipino woman, on bail.
The upper court's decision came after the Prosecutor General's Office appealed the Criminal Court's decision to release Lamha on bail for three months because of medical reasons to the High Court.
The High Court ruling said that the Criminal Court's ruling does not specify how the previous decision to keep the suspect in custody has been changed. It further said that while the trial has been prolonged due to the lack of resources and space at the court as per the Criminal Court, it's ruling does not clarify why the defendant cannot have a fast-track trial.
The High Court further said that there is no way to know how the Criminal Court has determined that the suspect does not pose a threat to the society and that the defendant cannot be seen as a person 'stuck' indefinitely in the criminal justice system.
The three-judge bench of the High Court unanimously ruled that the injunction issued by the Criminal Court to release the defendant on bail for three months have now been revoked and the injuction to keep her is remand custody till her trial is over is back in place.
Lamha was charged with accessory to murder along with two other charges for the death of Mary who worked at Indira Gandhi Memorial along with the two suspects in her murder.
Mary's husband, Marvin was charged with murder after he was arrested in October of 2021. Lamha was arrested in December of the same year.
