The Criminal Court has found a former State Trading Organization STO employee accused of criminal breach of trust not guilty of the crime.
The charges were filed against Moosa Yasir of M. Moosiru of Male'. The charges against him are that on August 19, 2008, when Musa Yasir was in charge of STO Construction Materials, he ordered a bill to be marked as paid before the company received the payment for the bill.
The charge sheet also highlights that STOC has not received MVR 299,200 due to the bill there was no written rule for the release of goods by the company at the time of the case.
The judgment also said that the witnesses and the evidence presented showed that it was not the responsibility of the issuer to ensure that the money was received before issuing the goods for a cash bill.
Defendant Musa Yasir said that his responsibility was to release goods for any bills that had been stamped by the cash counter and bills that have been stamped can be considered as having been paid by the customer.
The testimony of the man who stamped the bill was taken. The witness said that the bill was stamped the bill upon Moosa's order. However, the judgment noted that the prosecution had not presented any further evidence to prove it other than the employee's statement.
The prosecution has repeatedly tried to produce two of the witnesses in the case but they have not been able to produce them.
Considering the evidence of both parties, Judge Ibrahim Ihsan ruled that the evidence did not prove the accused guilty of breach of trust to the extent that there was no reasonable doubt.
