The High Court has rescinded the injunction order issued by the Civil Court over the letter sent by Male' City Council to Ninety Nine Holdings which was contracted to give buggy service in Villimale'.
The letter by the Council asked the company to vacate the lands leased to it as it was not adequately providing electric buggy service in Villimale.
While only a handful of engine-powered vehicles are allowed in Villimale, the contract to offer buggy service as a mode of public transport was first awarded to a company named Im Print back in June 2013. But this company handed over the contract to Ninety Nine Holdings in January of 2014.
But the City Council said that Ninety Nine has not been giving buggy services as per the contract. It has since decided to cancel the contract with the company.
Once Ninety Nine filed the case to the Civil Court, the Court issued an injunction on the City Council's moves against the company.
But the City Council appealed the injunction against it at the High Court and the upper Court had yesterday rescinded the lower court's injunction order.
The High Court bench said that the injunction order does not impact the actual verdict on the case and that the actual loss incurred can only be determined by doing a comparison between the two parties.
While City Council is preparing to give buggy services in Villimale next February, MTCC kicked off mini bus services on the island-ward earlier this month.
