One of the defendants in the murder case of Igmh Nurse Mary, Lamha Ahmed has denied the statements made by the State that the victim had no medical charts.

Nurse Mary was found hanging in her apartment last year in an apparent suicide but authorities later determined that she was murdered and made to look like she took her own life.

The State charged her husband Marvin SY Vagas with murder after he was arrested shortly after her death. The State has also charged local nurse Haleemath Lamha with accessory to murder. Both Marvin and Lamha also worked at IGMH as nurses and were romantically involved with each other.

At the hearing of the case yesterday, Lamha's lawyer Abdullah Shairu said that since the defense has requested the medical charts of the victim, it would not question witnesses unless the charts are made available.

In response, the state Prosecutor for the case, Ahmed Naufal said that it was still unclear whether the victim had medical charts or not and that IGMH would be clarifying the matter today.

But the presiding Judge ruled that relevant witnesses cannot be questioned without clarification.

At today's hearing, the State said that IGMH had informed them that there would be no medical chart for patients who are declared dead on arrival at the hospital and that only a death summary would be issued for such patients. But added that it would ask why such a document was not available.

Refuting this, Defendant Lamha said that every patient who is taken to the hospital would have a big file with their medical charts and that this would include the treatment given to the patient.

Lamha's lawyer said that documents showed that Mary was given treatment on her way to the hospital as well as in the hospital. He said that saying that there were no medical charts, meant that authorities were hiding something. He added the State has run out of the time given by the court to produce the medical charts.

Presiding Judge Hussain Faiz Rashaad said that he did not believe that the State had acted as per the Court's order and ordered the State to further probe the matter.

At today's hearing, four witnesses gave their statements. The state has presented 110 pieces of evidence against both the defendants and this includes 74 witness statements and 36 pieces of documentary evidence.
